但在實務上，摘要是否可以拿來做專利爭議的判決依據，是由法官自由心證，很多甚至不採納，但也曾有判例做依據。
水果公司在除了摘要之外的三百多頁，其實有對UI的配置、手勢的方向、角度、提示符號的位置都做了詳細的說明與圖例，
因為太明確了（幾乎純粹在說明iPod Touch與iPhone），因此就我感覺起來，不像是那種能夠獨占多點觸控市場的專利。

　Multi-touch 最早是由 Fingerworks 公司所商品化，而 Fingerworks 公司早已於 1999 年被 Apple Inc. 所併購，其他競爭產品如 Microsoft surface 的發軔皆晚於 2001 年，除非比 Fingerworks 更早開發 Multi-touch 的貝爾實驗室能向美國專利局提出既成應用的證據，否則蘋果公司對 Multi-touch 的專利權可以說是已經叼在嘴裡了（而且正當性十足！）。

有人提到2009年NOKIA會有六款觸控機發表。
對照之前官方宣稱要推出高中低各等級的觸控機種的消息，還蠻可信的。
如果5800XM、N97甚至6208c都算進去，也還有三款未發表的，這三款裡可能就會有低階的S60觸控機種（甚至S40的，因為有6208c的例子了）。
