撇開中國黑心廠商不說套一段自由軟體基金會創辦人Richard Stallman 說的話：「專利權本身的目的是為鼓勵人們將新創概念公佈出來，但現行的專利體系卻會造成反效果」他認為，專利文件雖然被公開，但事實上根本不會有人去讀，「因為沒有人是透過專利文件來學習新技術的，更不可能有人會願意去學習這些即使學到了卻會被禁止使用的技術」當然，必須要有「利」才會有人肯創造只是現行制度只是讓這些 Patent Troll 大行其利而已
